This document sets out the withdrawal and cancellation rights applicable to commissions placed through ignatiadi.com. The rights described below vary depending on the customer’s country of residence.
Important Notice
The products and services offered through ignatiadi.com are predominantly goods made to the customer’s specification. Under EU law (§312g(2)(1) BGB / Article 16(c) of Directive 2011/83/EU), the right of withdrawal does not apply to goods that are made to the consumer’s specifications or are clearly personalised.
A. Exclusion of the Right of Withdrawal
1. Commissioned Artwork
Individually created paintings made to the client’s specification via the Commission Specification Form. The client determines the technique, format, subject, and special requirements.
No right of withdrawal applies.
2. Hand-Painted Wearable Art
Hand-painted unique garments individually designed for the client. Each item is painted by hand according to the client’s wishes and is clearly tailored to the client’s personal requirements.
No right of withdrawal applies.
3. Personalised Print-on-Demand Products
Print-on-Demand products personalised to the client’s individual requirements (e.g. individually printed garments or posters with client-specific artwork or text).
No right of withdrawal applies.
B. For Consumers within the European Union
In accordance with Article 246a §1(3)(1) EGBGB, we inform you that you cannot withdraw from the contract because the goods are manufactured according to your specification (§312g(2)(1) BGB).
The exclusion of the withdrawal right does not affect your statutory warranty rights under §634 BGB. If the completed work deviates from the approved specification, you are entitled to supplementary performance, rescission, price reduction, or damages under statutory provisions.
C. For Consumers in the United Kingdom
Under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, the right to cancel does not apply to contracts for the supply of goods that are made to your specifications or are clearly personalised (Regulation 28(1)(b)).
Your rights under the Consumer Rights Act 2015 are not affected. The work must be carried out with reasonable care and skill and must conform to the agreed specification.
D. For Customers in the United States
US federal law does not provide a general right of withdrawal for online purchases. The FTC Cooling-Off Rule (16 CFR Part 429) applies only to sales made at the buyer’s home or certain temporary locations, not to online transactions. As all commissions are custom work made to the client’s specification, no return or refund is offered beyond the statutory warranty provisions.
E. For Customers in Other Countries
Customers outside the EU, UK, and US are advised to review the consumer protection laws of their country of residence. Where mandatory local provisions grant withdrawal or cancellation rights for custom-made goods, those rights remain unaffected.
